Terms of Service

§1. General Provisions
- These Terms of Service define the rules for using the website itpotwojemu.pl (hereinafter: "Website").
- The owner and administrator of the Website is Filip Krasiewicz, operating a sole proprietorship under the name IT Po Twojemu, with registered address at ul. B. Prusa 12, 05-270 Marki, Poland, Tax ID (NIP): 125 172 95 90 (hereinafter: "Service Provider").
- The Website is primarily intended for businesses and individuals conducting business activities (B2B).
- Using the Website constitutes acceptance of these Terms of Service and the Privacy Policy.
§2. Definitions
For the purposes of these Terms, the following definitions apply:
- Website – the website available at itpotwojemu.pl including all subpages
- Service Provider – Filip Krasiewicz operating the business IT Po Twojemu
- User – any natural person, legal person, or organizational unit using the Website
- Consumer – a natural person entering into a transaction with the Service Provider that is not directly related to their business or professional activity (Art. 22¹ of the Polish Civil Code)
- Entrepreneur with consumer rights – a natural person entering into an agreement directly related to their business activity, where the content of such agreement indicates that it does not have a professional character for that person, resulting in particular from the subject of their business activity as disclosed in the Central Register and Information on Economic Activity (Art. 385⁵ of the Polish Civil Code)
- Services – business process automation, system integration, and IT consulting services provided by the Service Provider
- Contact Form – electronic form available on the Website enabling contact with the Service Provider
§3. Scope of Services
- The Service Provider offers the following categories of services:
- Business process automation (Make, n8n, Zapier)
- System and application integration (ERP, CRM, e-commerce)
- Process audit and digitization strategy
- IT tools optimization consulting
- Detailed scope, conditions, and pricing of services are determined individually and are subject to separate agreements with Users.
- The Website provides free access to:
- Information about the Service Provider's offerings
- Contact via form, phone, WhatsApp, or meeting booking
- Scheduling a free initial consultation
§4. Technical Requirements
Proper use of the Website requires:
- A device with Internet access
- A current web browser (Chrome, Firefox, Safari, Edge)
- JavaScript enabled
- An active email account (for correspondence)
§5. Rules of Website Use
- The User agrees to use the Website in accordance with applicable law, good practices, and these Terms of Service.
- The following actions are prohibited:
- Actions that may disrupt the proper functioning of the Website
- Sending content that is illegal, offensive, or violates third-party rights
- Using the Website to send unsolicited commercial information (spam)
- Copying, modifying, or distributing Website content without the Service Provider's consent
- Using automated data extraction techniques (scraping) without the Service Provider's consent
- Information provided in the contact form must be true and current.
§6. Intellectual Property Rights
- All content published on the Website, including texts, graphics, logos, icons, photographs, and page layout, is owned by the Service Provider or used under appropriate licenses.
- This content is protected under copyright and industrial property law.
- Using any materials from the Website for purposes other than personal, non-commercial use requires prior written consent from the Service Provider.
- The "IT Po Twojemu" brand and related graphic elements are protected and may not be used without permission.
- Educational materials and code snippets: Educational materials provided free of charge on the Website, including automation scenario fragments (Make blueprints, n8n workflows, JSON files), may be used by Users exclusively:
- For the User's own business purposes
- Without the right to resell, sublicense, or commercially distribute to third parties
- With the obligation to retain source attribution (IT Po Twojemu)
- Automation scenarios, integrations, and solutions created individually for Users as part of paid Services are subject to separate contractual arrangements regarding transfer of rights or licensing.
§7. Liability
- The Service Provider makes every effort to ensure that information published on the Website is current and reliable, but does not guarantee its completeness or timeliness.
- Content on the Website is for informational purposes only and does not constitute an offer within the meaning of the Civil Code, legal advice, or tax advice.
- The Service Provider is not liable for:
- Temporary unavailability of the Website due to maintenance or factors beyond the Service Provider's control
- Damages resulting from force majeure
- Illegal actions by third parties
- Decisions made based on information contained on the Website without consulting the Service Provider
- Third Party Dependencies: Due to the nature of services based on external automation platforms (Make, n8n, Zapier, and others), the Service Provider does not guarantee uninterrupted operation of delivered automations in case of:
- Failures, technical outages, or API changes by the platform providers
- Changes in pricing policies or terms of use of external platforms
- Discontinuation or modification of features by platform providers
- Unauthorized modifications: The Service Provider is not liable for damages to the User's IT infrastructure (including data loss in CRM, ERP, e-commerce systems) resulting from:
- Unauthorized modifications to automation scenarios made by the User or third parties
- Improper use of delivered solutions contrary to documentation
- Changes to User's source systems without prior agreement with the Service Provider
- The Service Provider's liability for Services rendered is determined in separate agreements with business Users, subject to the rights of Consumers and Entrepreneurs with consumer rights arising from mandatory legal provisions.
§8. B2B Cooperation Terms
- Cooperation with businesses is carried out based on individual agreements specifying detailed scope, deadlines, remuneration, and liability of the parties.
- The initial consultation is free of charge and does not obligate either party to enter into an agreement.
- The Service Provider reserves the right to refuse to provide services without stating a reason.
- All materials, documents, and solutions created during cooperation remain the property of the party specified in the agreement.
- The parties agree to maintain confidentiality of information obtained during cooperation unless the agreement provides otherwise.
§9. Complaints
- Complaints regarding the functioning of the Website can be submitted to: privacy@itpotwojemu.pl.
- A complaint should include:
- Contact details of the complainant
- Description of the problem
- Expected resolution
- The Service Provider processes complaints within 14 days of receipt.
- Complaints regarding provided Services (other than Website functionality) are handled according to terms specified in individual agreements.
§10. Final Provisions
- The Service Provider reserves the right to amend these Terms of Service. Changes take effect upon publication on the Website.
- Matters not regulated by these Terms shall be governed by Polish law, particularly the Civil Code and the Consumer Rights Act.
- Court jurisdiction:
- For Users who are Businesses (not Entrepreneurs with consumer rights) – the court having jurisdiction over the Service Provider's registered office (Marki, Poland)
- For Consumers and Entrepreneurs with consumer rights – court jurisdiction is determined according to general rules (court for the defendant's place of residence or, at the claimant's choice, court for the place of performance of the obligation)
- Alternative dispute resolution: Consumers have the option to use out-of-court methods for handling complaints and pursuing claims, including:
- ODR Platform: ec.europa.eu/consumers/odr
- Mediation conducted by relevant Provincial Inspectorates of Trade Inspection
- If any provision of these Terms is found to be invalid or unenforceable (particularly as an abusive/unfair clause), the remaining provisions shall remain in effect.
- These Terms come into force upon publication on the Website.
